Container Homes in Mississippi: Zoning, Code and the Site

A container home in Mississippi is a house project first. The parcel's zoning, the building code the city or county enforces and the ground under the site decide what can be built before any container is ordered.

Zoning Comes First

Mississippi leaves land use to cities and counties, so the first question is whether a home of this kind is allowed on the parcel at all. Gulfport's zoning ordinance defines an intermodal shipping container used as a building component for a home and says that, for zoning purposes, it is not a mobile, manufactured or modular home. Section IV(A)(11C) allows converted container homes only in shipping container parks, which must be existing manufactured home parks in the R-B residence-business district, with Planning Commission approval, and never on an individual lot. Each home sits on a permanent foundation, and the ground anchors used for manufactured homes are not permitted. The same ordinance says an accessory building cannot be used as a dwelling unit.

Jackson's zoning ordinance does not use the term container home, so ask the Zoning Division how a proposed container house would be classified. In the R-1 district, a structure used as living quarters for family members, temporary guests or domestic help on the same lot as the main house needs a use permit, with a covenant that it will never be rented and electric service metered from the main house.

In Hattiesburg, start with the Planning Division, which can say how the Land Development Code, updated March 17, 2026, treats a container home on your parcel. A container kept beside a house as an accessory structure, such as a workshop, needs a certificate of zoning compliance under Section 5.4.2.4.

The Building Code

Section 17-2-4 of the Mississippi Code has a county or city adopt one of three options as minimum codes. The options are one of the last three editions of the International Building Code, one of the last three editions of the International Residential Code, or other codes such as electrical, plumbing, mechanical, fire and fuel gas codes. A county or city could opt out of that requirement during the 120 days after August 1, 2014, as a 2024 Attorney General opinion explains. Section 17-2-1 sets separate code requirements, including wind and flood rules, for Hancock, Harrison, Jackson, Pearl River and Stone counties in south Mississippi and for the cities in them. That Jackson County lies on the coast and does not include the capital city of Jackson. The city of Jackson enforces the 2018 International Residential Code with local amendments, Hattiesburg lists the 2018 International Residential Code as its building code, and Section 3-26 of the Gulfport Code of Ordinances adopts the 2018 International Building Code.

A container home goes through plan review like any other house. Expect the building department to ask for plans that show the structure, the foundation and every opening cut into the steel. Hattiesburg asks that residential plans be prepared by a registered architect or design professional.

Factory-Built Container Homes

Some container homes are built in a factory and delivered as finished modules. Mississippi's Office of the State Fire Marshal reviews the construction plans of modular buildings submitted by licensed modular building manufacturers, and the drawings must specify the design wind speed, the exposure type, the flood hazards and the foundation instructions. If a builder offers a finished container home, ask whether it holds a Mississippi modular manufacturer license and whether its plans have been through that review.

The Site: Clay, Water and Wind

Around Jackson, Mississippi's Office of Geology rates the Yazoo clay a high risk for construction because of its shrink-swell potential, and its geology bulletin places weathered Yazoo clay under most of Jackson and the Jackson Prairie, a belt of prairie land across central Mississippi. A permanent home there needs a foundation designed for that soil, not blocks under the corners.

On the Mississippi Gulf Coast, flood zones and wind shape much of the design. Gulfport's flood damage prevention ordinance, Appendix B of the city code, requires a floodplain development permit before any development in a special flood hazard area and sets elevation and anchoring standards for buildings. Ask the building department which design wind speed and exposure the plans must use at the address.

In the Delta, the clay soils of the Mississippi River flood plain, such as the Sharkey series, are poorly drained and very slowly permeable. Plan the site drainage and the driveway together, because both have to work in a wet season.

Delivery access belongs in the plan. Each container arrives on a truck that needs a straight, open run of 110 feet for a 20ft unit or 130 feet for a 40ft unit, at least 15 feet of overhead room to drive in, 22 feet of overhead room over the whole unloading path and 10 feet of width, per Container One's delivery FAQ. Containers that will be stacked or set on a raised foundation may need a crane, so settle the set-down plan before the design is final.

A Practical Sequence

  1. Confirm which city or county governs the parcel, and ask whether a container home is allowed there.
  2. Ask the building department which code edition applies and what the plans must show.
  3. Check the truck route and the set-down area, including whether a crane is needed.
  4. Have a design professional plan the foundation for the soil, the flood zone and the wind.
  5. If the home will be built off-site, confirm the builder's modular license and plan review.
  6. Order the containers once the design is final.
